Terms of Use

These Terms of Use govern the use of the mobile application "kokoii" (hereinafter referred to as the "App"). By using the App, you agree to be bound by these Terms. Please read them carefully before using the App.

Article 1 (Scope of Application)

These Terms of Use apply to all users of the App. Users are obligated to comply with these Terms.

Article 2 (Use by Minors)

• Minors must obtain the consent of their legal guardian (e.g., parent) before using the App.
• If a minor uses the App without such consent, their actions during the period of minority are deemed ratified by their legal guardian.

Article 3 (Use of Content & Map Data)

• Content provided by the App (text, images, etc.) is licensed for personal, non-commercial use only.
• The App utilizes Google Maps API to provide map functionalities. By using the App, you also agree to be bound by the Google Maps/Google Earth Additional Terms of Service.
• Reproduction, modification, distribution, publication, or commercial use of the App's content or map data beyond the permitted scope is strictly prohibited.

Article 4 (Premium Services)

• The App Developer may offer "Premium Services" which provide paid features or benefits within the App.
• Premium Services are a one-time purchase, granting permanent access upon completion of the single purchase process.
• Fees and details of Premium Services will be specified in the App or as designated by the App Developer.
• Once a purchase is made, no refunds will be issued, except where required by law.
• Users who purchase Premium Services can enjoy benefits such as an ad-free experience, additional functionalities, and other perks as determined by the App Developer.
• The App Developer may change the content or conditions of Premium Services. In such cases, the App Developer will provide prior notice or an in-app announcement of the changes.

Article 5 (Display of Advertisements)

The App may display advertisements from the App Developer or third parties. Ad content may be managed by third-party ad providers (e.g., Google AdMob).

Article 6 (Use of Analytics Tools)

The App uses analytics tools, such as Google Analytics for Firebase, to analyze usage and improve quality. The use of these tools is subject to their respective providers' Terms of Service and Privacy Policies. For details, please refer to Google's Privacy Policy.

Article 7 (Prohibited Actions)

Users must not engage in the following actions when using the App:

• Actions that violate laws or public order.
• Actions related to criminal activities.
• Actions that infringe on the App Developer's or third parties' intellectual property, privacy, or other rights.
• Actions that interfere with the App's operations (e.g., excessive server load, system tampering).
• Unauthorized access or attempts thereof.
• Decompiling, reverse-engineering, or otherwise analyzing the App's source code.
• Other actions the App Developer deems inappropriate.

Article 8 (Usage Restrictions)

The App Developer may restrict or suspend a user's access to the App in the following cases:

• Violation of these Terms of Use.
• Actions that hinder the App's operations.
• Other cases where the App Developer deems continued use inappropriate.

The App Developer is not liable for any damages resulting from such restrictions.

Article 9 (Service Suspension)

The App Developer may suspend all or part of the App's services in the following cases:

• During system maintenance or updates.
• When service provision is difficult due to force majeure (e.g., earthquakes, fires, power outages, communication failures).
• Other cases where the App Developer deems service provision difficult.

The App Developer is not liable for any damages resulting from service suspension.

Article 10 (Service Changes)

The App Developer may modify, add, or terminate the App's content without prior notice to users. The App Developer is not liable for any damages resulting from such changes.

Article 11 (Disclaimer)

The App Developer is not liable for the following:

• Damages incurred by users due to the App's use (e.g., data loss, device issues).
• Accuracy, completeness, or timeliness of information provided by the App.
• Content or safety of third-party content (e.g., advertisements, map data).
• Damages due to the App's unavailability or interruption.
• Damages from disputes between users or with third parties.

The App Developer is not liable for user damages except in cases of intentional or gross negligence.

Article 12 (Handling of Personal Information)

Personal information collected through the App will be handled appropriately in accordance with the App Developer's Privacy Policy. For details, please refer to the Privacy Policy within the App.

Article 13 (Governing Law and Jurisdiction)

• These Terms of Use are governed by and construed in accordance with Japanese law.
• Disputes related to the App shall be subject to the exclusive jurisdiction of the district court in the location of the App Developer's head office.

Article 14 (Changes to Terms of Use)

The App Developer reserves the right to modify these Terms of Use as needed. Modified Terms take effect upon publication in the App. Users are obligated to periodically check for changes, and continued use of the App after such changes constitutes agreement to the modified Terms.
